Amendment of Terms
We reserve the right to change, modify, add or remove portions of these terms at any time. Please check these terms regularly to ensure you are aware of any changes. We will endeavour to highlight any significant or substantive changes to you where possible.
Our Commitment
Transform Tree Care is an owner/operator business and is led by an experienced and qualified Arborist who has successfully completed AHC30816 – Certificate III in Arboriculture – Participant # 9526719.

1. Interpretation
a) Vendor means Transform Tree Care.
b) Client means any person, firm or company to whom a quotation is made by the Vendor or by whom an order is placed for Goods/Services.
c) Contract means a contract for the supply of Services with or without installation into which are hereby incorporated these Terms and Conditions.
2. Quotation
a) A free quote is provided by Transform Tree Care for Services directed by the Client. A quotation may be amended or withdrawn at any time before acceptance by the Vendor of an order given against it. Written quotation prices are only valid for a period of seven (7) days. All other prices are subject to change without notice.
b) Transform Tree Care will provide preliminary feedback and opinions regarding work outlined. In the event Transform Tree Care is asked to provide more than preliminary feedback (i.e. – health assessments including diseases, infestations, tree ID and recommendations), a consultation fee will be applied and this fee will be supplied to the Client by Transform Tree Care before Services are undertaken.
3. Price
a) Unless otherwise stated in writing by Transform Tree Care, quoted prices are exclusive of GST.
b) Any variation or additional works shall attract a further charge, as discussed onsite or via email or phone by Client. In the unlikely event additional machinery and associated costs is required to finish works due to tree instability or safety, Transform Tree Care will require Clients sign off to finalise work. Failure to sign off will still require full payment of original invoice. The only circumstances where any variation to terms will apply is where Transform Tree Care has expressly agreed in writing to such variation.
4. Contract
a) A Contract is formed between the Vendor and the Client when a quotation is accepted by the Client.
b) These Terms and Conditions form the entire agreement between the Vendor and the Client in relation to the purchase and supply of the Goods to the exclusion of all other terms and conditions. If a Client’s terms and conditions are supplied in connection with an order, those terms and conditions will have no legal effect and will not constitute part of these Terms and Conditions (even if the Vendor accepts or fulfils the Client’s order, or a representative of the Vendor agrees to the Client’s terms and conditions).
c) A Contract is valid for thirty (30) days.
5. Delivery
a) Any date specified by the Client and agreed upon by Transform Tree Care is considered finalised.
i. If the Client changes this date more then three (3) times, they will be subject to a $100 re-scheduling fee (in addition to the price outlined in the Contract).
ii. If a client accepts a Quote and schedules a job more than thirty (30) days in advance, they will be required to pay a $100 non-refundable deposit at the time of booking. This amount will be removed from the final invoice upon completion of the services.
b) The Vendor may deliver the Services by more than one delivery, in which case and unless agreed otherwise in writing, the Client will not be entitled to:
i. Terminate the
Contract
ii. Withhold payment for the Services or the value Services delivered
iii. Costs or damages arising from such delivery or any delay in any delivery of the Goods.
c) In no event shall the Vendor be liable for delay caused by, or in any way incidental to an act or event of Force Majeure, breakages of machinery or industrial conditions or arising out of any other unexpected or exceptional cause, or any cause beyond the Vendor’s reasonable control.
d) All bookings are subject to weather conditions and as such inclement weather may result in bookings being rescheduled. Whilst every effort shall be made to anticipate weather related cancellations, Transform Tree Care may be required to reschedule bookings without prior notice.
6. Services Undertaken
a) It is the Clients responsibility to move any plants or furniture before commencement of work. Transform Tree Care does not accept responsibility for damage as a result of moving such items. The Client is also responsible for providing a clean working area/site. In the event that Transform Tree Care has to clean the site then further costs will be incurred.
b) All materials will be removed from the site unless otherwise agreed upon and stated in the Contract by the Client. Materials will be left onsite at the Client’s request only if safe to do so. The removal of materials refers only to the work undertaken by Transform Tree Care and does not include debris already on the property.
c) Trees will be cut to the ground level, this means as close to the ground as possible without causing damage to equipment.
d) Transform Tree Care is diligent in ensuring any wood marks or scratches to driveways and/or property are minimal but does not take responsibility for such wood marks or scratches.
e) Transform Tree Care prunes trees to the Australian cutting standard AS 4373 Pruning of Amenity Trees. Variations to the standard are at Clients request.
f) Transform Tree Care will not take any responsibility for any tree that has been topped or lopped at the Clients request, which is done without our recommendation.
g) Transform Tree Care will grind stump/s 200mm below ground level follow industry standards. Transform Tree Care takes no responsibility for any underground services hit above this level (200mm). In the event pipes or plumbing is damaged all effort will be made to contact the client immediately and services turned off where applicable. Transform Tree Care does not accept responsibility (beyond its reasonable control) for damage sustained to doors, windows or any other property from stump grinding debris. All wood chippings and backfill will be put in the stump hole to settle over time. If desired, Client can replenish the site with soil.
7. Payment
a) The Client is required to pay Transform Tree Care upon completion of the Services within seven (7) days.
b) In the event payment is not received within the original due date (as shown on invoice), the Client may incur a late fee of 10% which will be added to the invoice price after the initial payment period has ended.
8. Cancellation
a) Cancellation of bookings must be made seven (7) full business day to scheduled job commencement. Cancellations received inside of seven (7) full business day will incur a fee of $500 excluding GST. or the value of the job if under $500 excluding GST.
b) In the event of such a cancellation, variation or suspension the Client undertakes to reimburse and indemnify the Vendor for any additional costs expenses or charges incurred by the Vendor and profit which the Vendor may reasonably have expected to receive in preparation for and in the execution of the Contract.
9. Marketing
a) By accepting a Contract, the Client agrees that Transform Tree Care may use images/videos of the work undertaken as well as written testimonials for marketing purposes. Transform Tree Care will attempt to exclude objects from images that may identify the Client.
b) If a Client does not consent to this, they are required to inform Transform Tree Care before acceptance of the contract.
